In order to bait the man accused of molesting his daughter, a Santa Clara County prosecutor used the 13 year old to bait the suspect. Police were already leading an investigation into the molestation’s that took place at the Los Alamitos Trail in Almaden Valley, California. The investigation began one day after the victim alerted her doctor that she had been sexually assaulted while waling her dog.

To lure the victim the prosecutor instructed his daughter to walk back and forth on the trail while they stayed in contact with each other through cell phones connected to ear buds. According to the police report written by San Jose Sgt. Sean Pierce, the prosecutor and his daughter “had already done this several times”. “He instructed (the victim) to let (the suspect) touch her if she encountered him, but if it was the breast or between the legs to move away. He instructed (the victim) to let (the suspect) identify and make the contact and if she cannot handle things she should move away. He instructed the victim to walk back and forth on the designated route and don’t interact with anyone for very long.”

Early in November the prosecutor began going out on the trail and eventually spotted a man fitting the description of the man that molested his daughter and captured him on photo. The victim’s mother saw a man fitting the suspects description, and followed him a couple of blocks from the trail to his home. The parents subsequently reported the address to the police in order for them to conduct surveillance. The prosecutor then contacted the police on November 11 to alert them of the video he recorded during his surveillance operation. In the video the suspect is wearing the same tracksuit the victim had previously described the suspect as wearing. In the video the suspect can be seen walking with his arm around her waist. At one point the suspect an be seen grabbing the victim to keep her from walking away from him. According to the police report the victim “felt as if she was not allowed to leave.” Upon kissing the victim on top of the head, the suspect “allowed her to leave and the victim walked away”, as the suspect began to follow her. The prosecutor followed the two as the acts were taking place but lost sight of them twice.

On the following day 76 year old Mohammad Lajmiri of San Jose, California was arrested. According to Lajmiri he “put his arms around the victim’s waist, kissed her hand and head, and sat with her on a bench on November 11.” He claims he was trying to guide the victim back down to the bench, not pulling her. He also claimed that any contact with her “breasts and buttocks” was accidental, claiming any other contact was a “sign of affection as a fatherly figure”. According to the police report, Lajmiri claims Alzheimer’s prevents him from remembering the interactions.

Due to the conflicts of interest surrounding the case, the state Attorney General’s office s now prosecuting the case. Conflicts of interest arose due to the prosecutor being the victims father, and by conducting his own investigation to gather evidence. Prosecutors are said to be exploring child endangerment charges against the prosecutor.
